This Privacy Policy ("Privacy Policy") applies to any First Watch Technologies Inc. website, platform, mobile app, application, or portal ("Site") and the services provided on or through it or any other property operated by First Watch (the "Services"). Unless otherwise noted, all references to "us," "our," or "we" will be deemed to include First Watch Technologies, Inc. ("First Watch," or "Company"). Capitalized words used but not defined in this Privacy Policy shall have the meaning ascribed to them. By agreeing to the Privacy Policy, accessing the Site, or using, installing, or accessing any Service, you agree to the First Watch Terms of Use ("Terms") which the Privacy Policy incorporates by reference, and you agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue using the Site and Services.
This Privacy Policy applies to First Watch's collection and use of information that we may gather when you contact us, visit our Site, or use our Services. By installing, accessing, or using any Service, you expressly consent to the collection, processing, and use of your personal information in accordance with this Privacy Policy.
Collection of Data
Personal Information. Individuals or entities who register for a Service (a "Registered User") are required to provide certain personal information, such as name, mailing address, phone number, e-mail address and where applicable, credit card information ("Personal Information"), that we collect and use to perform the Services and for other purposes as described in this Privacy Policy.
We may receive Personal Information from third parties about consumers who were subject to a data breach, such as insurance companies or breach mediation companies. We may collect Personal Information on Sites from individuals and businesses.

First Watch will use your Personal Information to respond to requests and to perform the Services. First Watch will also use your Personal Information to market Services to you consistent with the terms of this Policy.
If you apply for a job on our Site, we require that you provide certain Personal Information. This information is necessary to process your application and to contact you. After you submit a completed job application you may receive communication acknowledging our receipt.
Disclosure of Personal Information
We may disclose your Personal Information to third parties while performing First Watch Services.
- To law enforcement when required by law;
- To an insurance company;
- To a representative of a payment verification service, financial institution, or credit card company; or
- To a consumer reporting agency or other organizations to obtain informational credit reports about you or a minor child for whom you have registered for Services.
We may also disclose your Personal Information to third party service providers to charge your billing account for fee-based Services and to develop and provide you with information regarding products and services that First Watch believes will be of interest to you.
In no event will we share, sell, rent, or trade your Personal Information with third parties to promote such parties' businesses.
In the event we engage in a business transaction, such as a merger, acquisition, sale of all or a portion of its assets, or bankruptcy, your Personal Information will likely be transferred to a third party in connection with such transaction.
User Rights Regarding Personal Information
Access and Correction. You can access and update/correct your Personal Information by accessing the password-protected, web-based First Watch administrative console by supplying your valid login credentials.
Communications. You may also be able to change the types of communications you receive from us by clicking on the appropriate “Manage Communications” link in our email communications to you. Please note that opting-out of receiving promotional email will not affect receipt of Service-related, transactional, or legal communications via email in accordance with the Terms.
Personal Information Disclosed to Third Parties for Their Marketing Purposes. You have the right to request what and when we have disclosed your Personal Information to third parties for their marketing purposes in the preceding twelve months. As noted above, we do not sell, share, barter or otherwise provide your Personal Information to third parties for their marketing purposes.
Sales of Personal Information to Third Parties. You have the right to request that we do not sell, share, barter, or otherwise provide your Personal Information to third parties for their marketing purposes. Deletion. You have the right to request that we delete the Personal Information about you that we have collected and maintained, subject to certain restrictions and exemptions allowed by law. If you are a Registered User of a Service, we will not delete your information until you have cancelled your Registration to the applicable Service or until your Registration is Terminated by us for non-payment of other violation of the Terms, as we require that information to perform the Services. We may retain user Personal Information following a deletion request as needed to comply with laws applicable to our business.

For security purposes, we reserve the right to verify your identity before fulfilling any of the above requests, including asking you to verify that you are the owner of the account associated with your Personal Information by signing into the account and following the directions provided.

Retention
We retain your Personal Information for as long as necessary to provide you with Services or conduct one or more of the purposes described above, and in accordance with our data retention schedule. We may retain your Personal Information for longer if it is necessary to comply with our legal or reporting obligations, resolve disputes, enforce contracts, address other legitimate business needs, etc., or as permitted or required by applicable law. We may also retain your Personal Information in a deidentified or aggregated form so that it can no longer be associated with you. To determine the appropriate retention period for your Personal Information, we consider various factors, such as the amount, nature, and sensitivity of your information; the potential risk of unauthorized access, use or disclosure; the purposes for which we collect or process your Personal Information; and applicable legal requirements.
Regarding Children
Neither the Site nor the Services are intended for anyone under the age of thirteen (13), other than as to minor children receiving our Services through registration by their parent or legal guardian. First Watch does not intentionally collect any Personally Identifiable information from children under 13 years old or knowingly distribute such information. Children under thirteen are not permitted to use our Site, and we request that children under thirteen not submit any Personal Information to us in any form. International Visitors
This Site and Services are hosted in the United States. If you are visiting the Site from a jurisdiction outside the United States, you understand and unambiguously agree and consent to the collection, maintenance, and processing of your Personal Information in the United States, which may not have privacy laws as protective as those in your jurisdiction.
Security
The security of your Personal Information is important to us. Your Personal Information is protected by the password you created when you completed the Registration User for Services or by changing a previous password. When you provide us with sensitive information (such as a credit card number) we encrypt that information using secure Transport Layer Security (TLS). If your browser is capable of TLS, your personal information will be automatically encrypted, or encoded, before it is transmitted over the Internet.
We follow generally accepted industry standards intended to protect the Personal Information submitted to us, both during transmission and once we receive it. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
